New offence for careless driversRSS Feed
People who cause a traffic accident as a result of dangerous or careless driving could face tougher prison sentences under new court guidelines outlined by justice secretary Kenneth Clarke.
A new offence, "causing serious injury by dangerous driving", would more double than the current two-year limit on sentences for offenders who cause accidents through negligence.
It will also carry an unlimited fine, although justice ministers say it can be difficult to prosecute in these cases as it can be tricky to prove that injuries were caused as a result of lapses in concentration.
"We have listened to the victims of dangerous drivers, their families, MPs, judges and road safety groups and their experiences have directly informed these changes," said Mr Clarke.
Road safety charity Brake has welcomed the news, saying it will help to provide justice to families whose lives have been affected by dangerous driving.
"We hope to see courts using the full range of sentences available for this and other serious driving offences," said Brake senior campaigns officer Ellen Booth.
