Sculpture accident 'entirely preventable'RSS Feed
Parents of a young boy may consider making an accident claim after a sculpture fell on him while he was playing football.
The boy, then aged five, was playing in Haddington near the Nungate Wheel sculpture, which was situated near to the children's play park.
He spent a night in hospital after the 81-kilogram sculpture fell onto his right foot, causing multiple fractures.
East Lothian Council was fined £6,000 after the Health and Safety Executive (HSE) found that there was no person or department within the council responsible for the upkeep of sculptures in the area.
HSE inspector Lindsey Stein said the incident had been "entirely preventable".
"If the council had appropriate systems in place to ensure structures installed on their property were done so to a suitable standard, and introduced regular inspections to check their stability, the damage to the Nungate Wheel would have been identified in time to repair it," she added.
This comes after laminate flooring company Universal Mouldings was fined following an accident at work which resulted in an employee’s hand being severely damaged.
