Building firm fined following accident at workRSS Feed
A building firm has been fined after a man was killed and two others seriously injured during a horrific accident at work.
Michael Whateley, 28, was crushed to death when a fork-lift boom fell on the car he was in.
The ceramic tiler was waiting in his car in Oxfordshire for the building plot to be unlocked with his brother Robert Whateley and Paul Keen.
Nearby, Keith Payne was carrying out checks of a telescopic materials handler when the truck tipped over and the forks from the boom landed on the car, crushing its roof.
Michael Whateley's injuries proved to be fatal while Robert Whateley suffered spinal injury and brain injury and Paul Keen experienced spinal injury and other broken bones.
Keith Payne was found guilty of breaching Health and Safety regulations and fined £7,000 while the company, Linden Limited, was fined £7,500 and ordered to pay costs of £25,000.
Following the hearing, Health and Safety Executive inspector James Powell said: "Construction sites have inherent risks, and even rough-terrain lift trucks have strict operational limits that need to be observed. With competent operation and suitable maintenance, tragedies like this should not happen."
